Contract checklist: agreement on image rights

Make sure that the rights are clearly written down before you deliver the images

§Basic information

  • 01The parties' names and contact details are written into the agreement
  • 02The scope of the assignment is described: type of shoot, number of photos, date and place
  • 03The price for recording and post-processing is clearly stated

§Rights — the most important section

  • 01It is clear whether the customer gets a usage right or full copyright to the images
  • 02It is described which media the pictures may be used in (web, print, social media, advertising)
  • 03It states whether the usage right is time-limited or permanent
  • 04It is agreed whether the photographer may show the pictures in his portfolio and on his own channels
  • 05It is described whether the pictures may be resold or relicensed to third parties

§Personal data and consent

  • 01It is clarified whether consent must be obtained from people in the pictures before publication
  • 02For images of children under 15 years, consent from the person with parental responsibility is in place
  • 03It is described how and how long the image files are stored

§Before signature

  • 01Both parties have confirmed the agreement in writing, e.g. by email
  • 02Delivery format, resolution and deadline are filled in
  • 03It is agreed what happens if the customer wants extra pictures or changes later
